Aside from serious penalties including imprisonment, some offences give the State the power to restrain and take your assets including property, money and motor vehicles. Even if you haven’t been charged, you may have an interest in property that can be confiscated due to the actions of others.
EXAMPLE: A couple own a house as joint proprietors. The husband is charged with large scale drug trafficking which the wife has no knowledge of or involvement in. Police apply to forfeit the entire property as ‘tainted property,’ regardless of the wife’s interest in it. If they are successful she loses her interest without compensation.
We are one of the few criminal law firms that specialise in handling confiscation matters, both for those charged and 3rd parties. There are strict time limits to file objections to asset confiscation, if you’ve been served with a notice contact us immediately.
